Terms of Service
These Terms of Service ("Terms") form a binding agreement between you and PBX1 Fadez & Cuts ("PBX1", "we", "us", "our"), operated by RS SUMAN PTY LTD, and govern your use of our mobile app, web app and in-store services (together, the "Services"). By creating an account, making a booking or making a purchase you agree to these Terms.
1. Eligibility and accounts
- You must be at least 13 years old to create an account. Parents and legal guardians may book services on behalf of younger children and are responsible for that booking.
- You are responsible for keeping your login credentials confidential and for all activity on your account.
- You agree to provide accurate, current information and to keep it up to date.
2. Bookings, deposits and changes
2.1 Making a booking
When you book, you select a location, a service, a barber (where applicable) and a time. A booking is only confirmed once you receive a confirmation in the app or by email. Barber and service availability is subject to change at any time, including due to illness, training, equipment issues or other operational reasons. Where we need to change or cancel your booking we will offer the next available slot or a full refund of any deposit.
2.2 Deposits
Most appointments need no deposit; you simply pay at the shop. Some services or peak times may require a deposit at the time of booking, which is credited against the total cost of the service on the day. The current deposit policy is shown in the app at the time of booking and in Settings → Booking policy.
2.3 Rescheduling and cancellations
- You may reschedule or cancel free of charge up to 24 hours before your appointment.
- Cancellations or reschedules made less than 24 hours before your appointment may result in forfeiture of any deposit paid.
- The current cancellation policy and any short-notice fee are shown in the app under Settings → Booking policy and override any older wording you may have seen.
2.4 No-show fee
If you do not arrive for a confirmed appointment and have not cancelled in advance, a no-show fee equal to 50% of the booked service price may be charged where a payment method is on file, in addition to the loss of any deposit. Repeated no-shows may result in your account being restricted from future bookings.
2.5 Lateness
If you arrive more than 10 minutes late, your barber may need to shorten the service or reschedule you. You will still be charged for the full booked service.
3. Payments
- All prices are in Australian dollars (AUD) and include GST where applicable.
- Most payments are made in person at the shop. Where card payments are taken online or in-app, they are processed securely by Stripe and we do not store full card numbers on our systems.
- Receipts are issued after each transaction.
- Refunds for faulty services or products will be handled in line with your rights under the Australian Consumer Law.
4. Loyalty programme
- Loyalty points are earned on qualifying purchases at a rate displayed in the app. The rate may change at any time on prospective notice.
- Points have no cash value, cannot be transferred between accounts and cannot be sold or exchanged for cash.
- Points may expire after 12 months of account inactivity. You will be notified inside the app before expiry where possible.
- We may cancel, suspend or amend the loyalty programme at any time, including cancelling unredeemed points, where we reasonably believe it has been used fraudulently or in breach of these Terms.
- Closure of your account forfeits any unredeemed loyalty points.
5. Promotional offers
- Promotional offers (such as discounts, bundles and seasonal specials) are subject to the specific terms shown at the time of the offer.
- Unless we say otherwise, promotional offers cannot be combined with other offers or redeemed for cash.
- We may withdraw or vary any promotional offer at any time on reasonable notice.
6. Products and merchandise
- You can reserve hair-care products and merchandise in the app and pay for them at the shop when you collect them. Prices include GST at the till.
- We make reasonable efforts to display product colours, descriptions and prices accurately. Minor variations between in-app images and the physical product can occur.
- Defective products may be returned in line with the Australian Consumer Law. Please contact us within 14 days of in-store collection.
- For hygiene reasons, opened hair-care products cannot be returned unless faulty.
7. Reviews and user content
- You retain ownership of any reviews, photos or other content you upload. You grant PBX1 a non-exclusive, royalty-free licence to display, reproduce and distribute that content within the Services and our marketing channels.
- You must only upload content that you have the right to share. We may remove content that is unlawful, harassing, defamatory, obscene or otherwise inappropriate.
8. Acceptable use
You agree not to:
- Use the Services for any unlawful purpose.
- Attempt to reverse engineer, decompile or interfere with the Services.
- Use the Services to harass, abuse or endanger our staff, barbers or other customers.
- Use bots, scrapers or automated tools to access the Services.
We may suspend or close any account that breaches these Terms.
9. Health and safety in salon
Please notify your barber of any allergies, skin conditions or other health concerns before the service. We may decline to perform a service where we reasonably believe it could be unsafe.
10. Liability
To the maximum extent permitted by law:
- The Services are provided "as is" and "as available". We do not warrant that they will be uninterrupted, error-free or fit for any particular purpose, other than as required by the Australian Consumer Law.
- We are not liable for indirect, consequential, incidental, special or punitive losses, including loss of profits, loss of data or loss of goodwill.
- Our total aggregate liability arising out of or in connection with the Services is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, and (b) AUD $200.
Nothing in these Terms excludes or limits any consumer guarantee under the Australian Consumer Law that cannot lawfully be excluded.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified inside the app before they take effect. Continued use of the Services after the effective date of a change means you accept the updated Terms.
12. Governing law and disputes
- These Terms are governed by the laws of New South Wales, Australia.
- Each party submits to the exclusive jurisdiction of the courts of New South Wales and the courts of appeal from them, for any dispute arising out of or in connection with these Terms or the Services.
- Before starting any formal proceeding, both parties agree to use reasonable efforts to resolve the dispute in good faith by direct discussion.
